ORAL FLUID TESTING AUTHORIZED BY D.O.T.

Summary

Currently, oral fluid/saliva testing is authorized but not yet operational for DOT-regulated drug testing. It will be required only in directly observed urine collection scenarios where a same-sex observer cannot be provided, and only after at least two HHS-certified laboratories are available. Until then, urine testing remains the standard, and employers must follow existing DOT procedures.

D.O.T. RE-CONFIRMS MARIJUANA TO REMAIN A PROHIBITTED SUBSTANCE

Summary

The Department of Transportation (DOT) will not change its Marijuana prohibition, drug testing process or regulations, regardless of Rescheduling efforts.  This means that marijuana will still be classified as a Schedule I drug under the Controlled Substances Act (CSA) and will remain a prohibited substance for federally regulated employers. Employees subject to federal drug and alcohol testing regulations are not permitted to use marijuana, even for medical purposes.  Caution: Non-DOT Employers that prohibit the use of marijuana for medical or other purposes under their own independent authority remain subject to applicable state laws regarding testing for marijuana and personnel actions related to medical marijuana.

SOME MARIJUANA PRODUCTS MOVED TO SCHEDULE 3

ORAL FLUID TESTING TO REPLACE DIRECT OBSERVATION TESTING

Summary

The U.S. Department of Transportation revises its drug and alcohol testing procedures to require a directly observed urine collection in situations where oral fluid tests are 

currently required but cannot be conducted because oral fluid testing is not yet available. The rule also updates 

terminology in these procedures consistent with Executive Order (E.O.) 14168
